Can a nursing home itself be held liable for the wrongful acts of its employees?

Yes. Throughout the United States, employers are generally treated as liable for the on-duty wrongful acts of their employees under the legal doctrine of respondeat superior. If the staff member is classified by the court as an independent contractor rather than an employee, the nursing home will not be automatically liable but could still be held liable if it committed its own misconduct (negligent hiring or inadequate supervision, for example).

You can initiate a wrongful death claim under the Georgia wrongful death statute. A wrongful death claim can be filed by certain close relatives and, under certain circumstances, by the personal representative of the deceased victim’s probate estate.
